Enforcing judgments from UK courts in other European countries: Hague Convention 2019 consultation is closing

A quick reminder that the Ministry of Justice’s consultation that asks for views on the proposed ratification on the 2019 Convention will close on 9 February 2023.

Our sense is that there is broad support among cross border practitioners generally for the UK to adhere to the regime in the Convention. It should make recognition and enforcement procedures more certain, more predictable and more efficient. That said, the Convention does not apply to all civil claims and its scope is narrower than both the regimes that applied before the UK left the European Union (ie the Brussels I Regulation and the Lugano Convention).

Attached is our one page summary of the topic, which includes a link for submitting a response to the MoJ. We would expect a further update on things from the Ministry some time after Easter.

"the government believes that joining Hague 2019 stands to benefit both businesses and consumers operating and living across borders, between the UK and other countries... membership of Hague 2019 is considered to be a step that will support the UK legal sector"
